General conditions
ILP International Language Programmes S.L. (hereinafter called ILP), registered office is Via Laietana, 15 08003 Barcelona, Spain, organises and acts as agent for overseas bodies who offer and supply students and others with tuition and accommodation for language courses in the countries concerned, and may arrange insurance for students. ILP as agent effect all bookings and reservation for students unless notified to the contrary, and they may, at their discretion, intercede without charge on behalf of students who become in dispute with any persons or bodies in connection with any matters arising provided however ILP shall not therefore be liable or become liable in any way in connection with any such matter nor does it vouch for the content or accuracy of any brochures or publicity documents prepared for students by any such persons or bodies or published by ILP on behalf of such persons or bodies and it is accepted that students' possible remedies shall be against such overseas bodies only. ILP acts as booking agents only, and does not own or operate any school, accommodation, transport or other facility. All bookings are subject to the terms and conditions of the school, Travel Operator or other Principal and are their responsibility.
"The student" means a person or persons who have signed the application form for such a language course (or if under age a parent or person in loco parent’s of such person or persons). Where a booking is made for more than one student the body or organisation making the booking will be regarded as the student for the purpose of this agreement.
In consideration of the price agreed to be paid for its principal courses and accommodation as set out on the enrolment form the following terms and conditions shall apply as between the parties.
- Article 1 This agreement
1 This agreement is legally binding when the enrolment form is completed and signed by the student and accepted by ILP or if effect by telephone when the registration form has been completed by ILP with the insertion of the student's passport details AND/OR after ILP have received the agreed deposit.
2 The specific written approval of ILP is required for any variation of this agreement.
3 The Laws of Barcelona shall apply to this agreement. - Article 2 Payment Conditions
1 A deposit of € 200 is to be sent to ILP with a completed enrolment for each student enrolling. This deposit is non-refundable.
1.1 The remaining balance must be settled by the student and arrive at the office of ILP to the satisfaction of ILP four weeks prior to departure date or as per the date specified in writing by ILP. In the event of default of payment by that time, ILP shall be entitled to rescind this agreement in which circumstances the amount already paid is accepted by the student as being non-refundable. ILP reserve the right to sue for the balance payable for the whole booking.
1.2 Where a booking is made within 4 weeks of departure for the course the entire costs of the course and accommodation shall be received at the time of enrolment and the total amount due for the course and accommodation must be received by ILP in time for funds to have been cleared the day before departure in which case payment may be required by telegraphic transfer or such other suitable means to achieve this at the expense of the student. Due to fluctuations in currency rates and charges of carriers, prices may be subject to surcharge. - Article 3 Insurance and Premiums On enrolment, students may apply for holiday travel insurance to ILP who will then endeavour to arrange it on their behalf. Students are free to effect their own insurance cover, but must notify ILP that they do not require ILP to do this arrangements, on the enrolment form.
- Article 4 Travel Documents
1 Relevant travel documents should be arranged between a designated Travel Agent and the student or the student might make his/her own travel arrangements.
2 Students themselves must arrange prior to departure all necessary travel documents in connection with their travel abroad i.e. valid passport, valid visa (if required), driver's licence, green card. 2.2- Any costs, damages or other charges arising from cancellation or curtailment due to a student's failure to comply with (a) above shall be the sole responsibility of the student. - Article 5 Cancellation by the Student
1 Should this agreement be cancelled by the student the following provisions apply:
1.1 Cancellation must be notified to the ILP office in writing. The day notification is received at the ILP office is the designated cancellation day and the provisions laid out will apply. Cancellation up to 28 days prior to departure: loss of deposit only. Cancellation between 27 and 15 days prior to departure: loss of 40% of the total fees. Cancellation between 14 and 3 days prior to departure: loss of 75% of the total fees. No refund shall be given between 2 and 0 days prior to departure or after the day of departure or commencement of the course or no-assistance to it. In each case the day of departure shall be counted as day "0". Insurance premiums and transports costs remain the sole responsibility of the student in any event. - Article 6 Amendments or Postponements Students may, at the sole discretion of ILP, be permitted to change details of their reservations or postpone their start dates, provided that this is received not later than 28 days prior to commencement of the course. Notification of such changes or postponements must be made in writing to ILP. A charge of € 75 will normally be made for any amendment or postponement, through ILP may waive this charge, at its sole discretion, if the amendment or postponement is for the extension of the course or upgrading to a more expensive course or type of accommodation.
- Article 7 Alterations resulting from the actions of Third Parties ILP does no accept liability for changes in arrangements for transport, tuition, accommodation, insurance or any other matters where made by other parties and any legal rights or redress which a student may have must be solely directed to such other parties.
- Article 8 Complaints Notwithstanding the provisions of this agreement excluding legal obligation or liability on their parts nevertheless ILP will in the event of a complaint by a student against an overseas body in connection with its proffered course or associated accommodation, use their best endeavours to rectify the situation to the reasonable satisfaction of the student involved provided that such complaint was notified to the appropriate secretariat abroad as soon as reasonably practicable and the student has exhausted all other reasonable practicable solutions in the country involved.
- Article 9 Behavioural Expectation Students and people accompanying students are expected to behave in generally courteous and polite manner. The illegal use of drugs or rude or inconsiderate behaviour, or alcoholic consumption by minors is not considered acceptable. ILP reserve the right to refuse to serve and/or terminate the participation in the course as well as occupancy in accommodation of any person who behaves in an abusive or inconsiderate manner towards others, or who fails to comply with the rules and regulations of the school, at the sole discretion of ILP. ILP further reserve the right to send home, without escort and without refund, any participant who violates the terms of this article. The return trip will be at the expense of the participant or participant's family.
